Respecting Your Privacy

Kendhal Hart’s policy is to respect your privacy regarding any information I may collect while operating my website. This Privacy Policy applies to Kendhal Hart, PLLC [herein Kendhal Hart]. I adopted this privacy policy (“Privacy Policy”) to explain what information I may collect on my website, how I use this information, and under what circumstances we may disclose the information to third parties. This Privacy Policy applies only to the information I collect through the website and does not apply to my data collected from other sources. Depending on your activities when visiting my website, you may be required to agree to additional terms and conditions.

Information I Collect 

I collect information from and about you throughout the checkout process during any Kendhal Hart course or product purchase. Below is a summary of what I collect and store.

While you visit my store, I will track:

  • Location, IP address, referring site, date and time of visit, and browser type: I will use this for purposes like estimating taxes and shipping

  • Shipping address: I will ask you to enter this so we can, for instance, estimate shipping before you place an order, and send you the order.

  • I will also use cookies to keep track of cart contents while you’re browsing our site. 

When you purchase access to a course, I will ask you to provide your name, billing address, email address, phone number, credit card or payment details, state board-issued license information and optional account information like a username and password. I will use this information for purposes, such as, to:

  • Send you information about your account and order

  • Respond to your requests, including refunds and complaints

  • Process payments and prevent fraud

  • Set up your account for our store

  • Comply with any legal obligations we have, such as calculating taxes

  • Improve our store offerings

  • Send you marketing messages, if you choose to receive them

  • If you create an account, we will store your name, address, email, and phone number, which I  will use to populate the checkout for future orders.

  • If you register for a training course, we will use the state board-issued license information to confirm license status and verify eligibility for participation in training.

I generally store information about you for as long as I need the information for the purposes for which I collect and use it, and I am not legally required to continue to keep it. For example, I will store order information for seven years for tax and accounting purposes. This information includes your name, email address, and billing and shipping addresses. I will also keep comments or reviews if you choose to leave them.

The security of your Personal Information is important to me, but remember that no method of transmission over the internet or electronic storage is 100% secure. While I strive to use commercially acceptable means to protect your Personal Information, I cannot guarantee its absolute security. 

Cookies

To enrich and perfect your online experience, Kendhal Hart uses “Cookies,” similar technologies and services provided by others, to display personalized content, appropriate advertising, and store your preferences on your computer. A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. Kendhal Hart uses cookies to help identify and track visitors and my usage of Kendhal Hart’s website. Visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using Kendhal Hart’s websites, with the drawback that certain features may not function properly without the aid of cookies. By navigating my website without changing your cookie settings, you now acknowledge and agree to Kendhal Hart’s use of cookies.  

Members of my team have access to the information you provide me. My team members have access to this information to help fulfill orders, process refunds, and support you. My team can access:

  • Order Information: What was purchased, when who bought it, and where they should send it.

  • Registration Information: Your name, email address, state-issued board license information, and billing and shipping information.

Who I Share Your Information With

We share information with third parties who help us provide our services to you:

  • Payments: I accept payments through Stripe. I will pass some of your data to Stripe when processing payments, including information required to process or support the payment, such as the purchase total and billing information. See the Stripe Privacy Policy for details.

How Long I Retain Your Data 

I retain personal information provided during the registration process for training, consultation, and when a contact form is submitted on our website indefinitely. 

Your Rights & Choices 

You may request that any personal data I hold about you be corrected, amended, or deleted. This does not include any data we are obliged to keep for administrative, legal, or security purposes. 

Policy Changes 

Although most changes are likely to be minor, Kendhal Hart may change the Privacy Policy from time to time and at my sole discretion. Visitors are encouraged to frequently check this page for any changes to the Privacy Policy. Your continued use of this site after any change will constitute your acceptance of such change. 

Additional Information 

Kendhal Hart has taken measures to protect your data. These steps include using HIPAA-compliant forms and staff training in HIPAA and data protection. I will notify all impacted customers of a data breach as soon as possible. Occasionally I review information from licensing boards and participant supervisors to verify participants hold the required credentials to participate in the training.

Anonymity in Recorded Materials

Home Study Programs and Recorded Webinars: In any home study program that includes recorded webinars or other recorded content, I will take necessary measures to ensure that participants are not identifiable through name, image, or any other identifying details in the materials. This includes editing out identifiable information from recordings.

Consent for Use of Identifiable Information: If I plan to use any participant’s image, name, or other identifiable information in any recorded materials intended for home study programs, I will obtain explicit consent from the participant. This consent will be documented clearly and concisely, specifying the exact use of the participant’s information.

Information Sharing: Under no circumstances will identifiable participant information be shared outside of the consented uses without additional, explicit consent from the participant.
